General Terms & Conditions

Welcome. We believe that collecting art should be a relationship built on trust. These Terms & Conditions are here to provide a clear legal framework for your acquisition of works by Arjan Spannenburg. They ensure that you know exactly what to expect regarding the purchase, ownership, and quality of the artwork.

By placing an order on this website, you agree to these terms.

Article 1: Definitions

To ensure clarity, this is our reference:

  • L'Artiste / L'Entrepreneur : Arjan Spannenburg (trading as Spannenburg.Art).
  • The Client / You: The private individual or collector acquiring the artwork (not acting in a professional business capacity).
  • The Partner: Zerp Galerie, often responsible for the financial handling and invoicing of your purchase.
  • The Piece: The fine art photography or mixed-media creation you are acquiring.

Article 3: The Offer & Accuracy

We endeavour to present the artwork with the utmost fidelity. However, please be advised that screen colours may varySlight deviations in colour or contrast between the digital image on your screen and the physical Fine Art print do not constitute a defect or a valid ground for a liability claim.

  • Errors or pricing inaccuracies on the website are not binding.

Article 4: The Agreement

The sales agreement is final when:

  1. You have placed an order via the website.
  2. Your payment conditions, as managed by ZERP Galerie, have been met.
  3. You have received a digital confirmation of your order.

Article 5: Custom Works & Right of Withdrawal

This is a crucial clause regarding your order.

  • Période de réflexion standard : Under Dutch/EU law, you generally have 14 days to reconsider a purchase.
  • Exclusion for Custom Art (Important): Most pieces displayed on this site (specifically those presented via Diasec®, Dibond, Plexiglass, and framed presentations) are produced to order based on your specific choice of size and finish.
    • Pursuant to Article 6:230p of the Dutch Civil Code: The right of withdrawal does not apply to creations produced according to the client's specifications.
    • By purchasing a made-to-order piece, you acknowledge that the sale is final upon production.

Article 6: Prices & Payment

  • All prices listed include VAT (where applicable).
  • Payment must be fulfilled within 14 days of the order via the secure methods provided by ZERP Galerie.
  • The Artist retains full legal ownership of the artwork until the full purchase price is received.

Article 7: Delivery & Execution

We approach your deadline with consideration.

  • We aim to deliver within the stated production time (5–28 days).
  • Delivery dates are estimates. A minor delay does not entitle the client to compensation unless explicitly agreed otherwise in writing.
  • Upon receipt, you must inspect the packaging and artwork immediately. Any transport damage must be reported to us within 48 hours.

Article 8: Guarantee & Conformity

We guarantee that the artwork meets high museum-quality standards and the specifications listed.

  • Should the piece exhibit a technical flaw upon receipt (unrelated to transit or improper handling), we shall undertake its repair or replacement at our expense.

Article 9: Limitation of Liability

To the extent permitted by Dutch Law:

  • Spannenburg.Art is not liable for indirect damages, consequential loss, or lost profits.
  • Our total liability is strictly limited to the invoice amount of the acquired piece.
  • We are not liable for damage resulting from improper handling, hanging, or environmental factors (such as extreme humidity or direct sunlight) after delivery.

Article 10: Governing Law & Disputes

We hope it never comes to this, but legally:

  • All agreements are exclusively governed by Dutch Law.
  • Any disputes that cannot be resolved amicably will be submitted to the competent court in the Netherlands.

Article 11: Open Call Participation & Content Submission

By creating an account and submitting content (including but not limited to images, biographical data, and artistic statements) for an Open Call or artist profile, you agree to the following terms regarding your data and intellectual property:

11.1 Accuracy and AI Translation

The Artist/Entrepreneur agrees to our AI translation of the submitted information into multiple languages to enhance global reach. By submitting your data, you acknowledge that while we strive for accuracy, automated translations may contain nuances or errors. You grant us the right to process and display your information in various languages.

11.2 Grant of License & Usage Rights

You grant ART THAT MATTERS a perpetual, irrevocable, worldwide, and royalty-free licence to use, reproduce, display, and distribute your submitted images and text. This licence is granted for the following purposes:

  • The promotion and execution of the specific exhibition or Open Call.
  • The creation and maintenance of your dedicated artist pages on our platform.
  • General marketing, social media, and archival purposes related to ART THAT MATTERS.

11.3 Visibility & Optimization (EEAT / SEO) You acknowledge that the submission of your data is intended to increase your professional visibility. In turn, you grant us permission to do so, using your content to optimize this platform for search engines (SEO), Generative Experience Optimization (GEO), and AI/Large Language Model (LLM) training or indexing. This is conducted to strengthen the platform’s "Experience, Expertise, Authoritativeness, and Trustworthiness" (EEAT) for visitors.

11.4 Ownership & Warranty You retain the moral rights to your work. However, you warrant that you are the sole creator and copyright holder of the submitted materials and that your submission does not infringe upon the intellectual property rights of any third party. You indemnify this platform against any third-party claims arising from a breach of this warranty.

11.5 Finality of Submission Once content is published as part of an exhibition or an indexed artist profile, requests for removal will not be possible. Only in extreme circumstances will these requests be handled at our discretion, taking into account the integrity of the digital exhibition and the platform's SEO structure.
